The President has appointed Dr Justice Dhananjaya Yashwant Chandrachud, a Judge of the High Court of Bombay, as the Chief Justice of the High Court of Judicature at Allahabad.
 
An official press release said here today that the appointment would be with effect from the date he assumes charge of his office. 
 
Dr Justice Chandrachud, 54, graduated from St Stephen's College in Delhi in 1979 and then completed his LL.B. from University of Delhi in 1982 and LL.M. from Harvard University in the United States in 1984. He has a doctorate in jurdicial sciences from Harvard.
 
He served as Additional Solicitor General of India (1998-2000) and designated as a senior advocate in 1998.
 
He has appeared in several important cases involving public interest litigation, rights of bonded women workers, rights of HIV positive workers in the workplace, contract labour and the rights of religious and linguistic minorities.
 
He was appointed by the Supreme Court to submit a report on the state of beaches in Mumbai.
 
Hewas appointed as Additional Judge of the High Court at Bombay on March 29, 2000.

The President has, after consultation with the Chief Justice of India, transferred Mr Justice Adarsh Kumar Goel, Chief Justice of the Gauhati High Court, as the Chief Justice of the Orissa High Court.
 
An official press release said Mr Justice Goel had been directed to assume charge of the office of the Chief Justice of the Orissa High Court on or before October 24.
 
He will be succeed Mr Justice Abhay Manohar Sapre, currently the Chief Justice of the High Court of Manipur. Mr Justice Sapre has also been directed to take charge of his new assignment by October 24, the release said.
 
The President has also transferred Mr Justice Karanam Sreedhar Rao, Judge of the High Court of Karnataka, to the Gauhati High Court.
 
Similarly, Mr Justice Laxmi Kanta Mohapatra, Judge of the High Court of Judicature at Allahabad, as been transferred to the High Court of Manipur.
 
The President has appointed Mr Justice Prasanta Kumar Saikia, Additional Judge of the Gauhati High Court, to be a Judge of that High Court with effect from the date he assumes charge of his office, the release added.

Air India to start direct flights from Mumbai to Agra, Allahabad, Gwalior

National carrier Air India today said it would introduce direct flights from Mumbai to Agra, Allahabad and Gwalior with effect from September 9, 2013.
 
The flights will be operated by Alliance Air, a wholly owned subsidiary of Air India, a press release from the airline said.
 
The flight from Mumbai to Agra will operate twice a week on Tuesdays and Fridays. AI 9623 from Mumbai to Agra will depart at 1215 hrs and arrive in Agra at 1410 hrs while the return flight AI 9624 from Agra will depart at 1440 hrs and arrive in Mumbai at 1635 hrs.
 
The flight from Mumbai to Allahabad -will operate four days a week on Mondays, Tuesdays, Thursdays and Fridays. AI-9614 from Mumbai to Allahabad will depart at 0745 hrs and arrive at Allahabad at 0945 hrs. The return flight   AI 9613 from Allahabad will depart at 0915 hrs and arrive in Mumbai at 1115 hrs.
 
The flight from Mumbai to Gwalior will operate twice a week on Mondays and Thursdays. AI 9621 will depart from Mumbai at 1215 hrs and arrive in Gwalior at 1400 hrs while the return flight will depart from Gwalior at 1430 hrs and arrive in Mumbai at 1615 hrs.
 
"By offering a non-stop flight to these destinations, the airline will be fulfilling a long standing demand of passengers for a direct flight to Allahabad, Agra and Gwalior without a stopover at any other metro city. The airline is also offering attractive introductory fares on these sectors," the release added.

Additional Judges appointed to Allahabad High Court

The President has appointed Mr Rakesh Srivastava, Mr Surya Prakash Kesarwani, Mr Vipin Sinha, Mr Karuna Nand Bajpayee, Mr Manoj Kumar Gupta and Mr Anjani Kumar Mishra as Additional Judges of the Allahabad High Court.

An official press release said the appointments, in that order of seniority, would be for a period of two years with effect from the date they assume charge of their office.

North-Central Railway releases list of those killed in stampede at Allahabad

The North-Central Railway has released the names of 20 of the 36 people who were killed in a stampede at the Allahabad railway station yesterday evening.

The remaining 16 victims have yet to be identified and their bodies have been kept in the mortuary of the Medical College hospital in Allahabad, it said.

Death toll in stampede at Allahabad railway station reaches 36

At least 36 people were killed and several others injured in a stampede at the Allahabad railway station on Sunday evening on a day when more than three crore people had converged at the "sangam" in the city on the occasion of Mauni Amavasya during the ongoing Kumbh Mela, held once in 12 years.

At least 36 people were killed and several others suffered injuries in a stampede at the Allahabad railway station in Uttar Pradesh yesterday evening on a day when more than three crore people had converged at the "sangam" in the city on the occasion of Mauni Amavasya during the ongoing Kumbh Mela, held once in 12 years.

The North-Central Railway confirmed that at least 36 people had died in the tragedy and 20 of the victims had been identified. The 20 identified victims included 15 women and an eight-year-old girl.
 
The remaining 16 bodies were kept in the mortuary of the Medical College Hospital at Allahabad.
 
Prime Minister Manmohan Singh expressed shock at the loss of lives in the incident and sent his hearfelt condolences to the members of the bereaved families. He also wished those injured a speedy recovery.
 
"I have issued instructions to Ministry of Railways to provide all necessary assistance to the affected persons. My government assures an ex-gratia payment to the families of those who have lost their dear ones and to those who are injured from the Prime Minister's Relief Fund. The Central government will extend all possible help to the state government in relief operations," he added in a statement issued last night.

There was no clarity about the sequence of events that led to the stampede around 7 pm yesterday, but some reports said the incident occurred on platform number 6 of the station after the railing of an overbridge collapsed.
 
Television pictures from the scene showed several of the injured being rushed to hospital, even as many others lay waiting for medical help at the spot.
 
Sources said many of the victims were elderly persons. At least seven of the 20 identified victims were aged 60 or more.
 
The incident occurred when more than 1.5 lakh people had crowded into the Allahabad station to board trains for their journey home after a holy dip at the "sangam".

Union Railways Minister Pawan Kumar Bansal told journalists in New Delhi that, as per preliminary information available, at least 10 people had died in the incident.
 
Media reports from the scene put the number of dead at around 20.

Kumbh Mela likely to generate revenues of Rs 12,000 crore: ASSOCHAM

Airlines, hotels, tour operators and the state are likely to witness a big boom in their economic activities during the Kumbh Mela, beginning in Allahabad on Monday, and are likely to contribute Rs 12,000 crore to the state coffers, according to the Associated Chambers of Commerce and Industry of India (ASSOCHAM).

In a Forecast Paper on "Maha Kumbh Mela 2013- Possible Revenue Generation Resources  for Uttar Pradesh" brought out by ASSOCHAM, it has been projected that the event will generate additional employment opportunities for over 6 lakh people in sectors such as airlines & airports, hotels, tour operators, besides medical & eco-tourism. 
 
According to it, the unorganized sectors would also gain as the boom will bring to it the maximum economic gains.
 
The paper estimated that about 1 million foreign tourists are likely to visit India during hte period for religious and eco-tourism.
 
ASSOCHAM Secretary-General D S Rawat said Australia, United Kingdom, Canada, Malaysia, Singapore, South Africa, New Zealand, Mauritius, Zimbabwe and Sri Lanka are the countries which will account for large numbers of tourists.
 
The hotel industry is aiming to achieve 100 per cent occupancy during the period from the current levels of 70 per cent. The duration of stay of foreign tourists in India is expected to 20-30 days. The sector is expected to employ over 2.5 lakh skilled and unskilled workers during the period.

Apart from Allahabad, where the Kumbh Mela is held once every 12 years, nearby locations such as Agra and Lucknow in Uttar Pradesh; Jaipur, Udaipur, Bhilwara and Kota in Rajasthan; Nainital, Mussourie, Aulli, Dehradun, Haridwar, Ranikhet and Almora in Uttarakhand; Chandigarh; Amritsar and Ludhiana in Punjab; and Shimla, Kufri and Manali in Himachal Pradesh are also expected to see a surge in tourist arrivals during this period, the paper said.
 
Uttar Pradesh Tourism, privately owned hospitals, traders, railway and international airport are likely to earn revenues of over Rs. 1,500 crore during the Kumbh Mela through increased inflow of foreign and domestic tourists.
 
“The Maha Kumbh will generate so much of direct and indirect activities in almost every key segment that touches masses with large number of beneficiaries, the fruits of which hopefully benefit the masses of Uttar Pradesh," Mr Rawat added.

PM monitoring availability of water in Ganga at Allahabad during Kumbha Mela

Prime Minister Manmohan Singh has been monitoring the availability of adequate water from Tehri Dam in river Ganga at Allahabad during the Kumbh Mela, which will begin on January 14 and end on March 10, and directions have been given to control the pollution load flowing in river Yamuna during the period.

An official press release from the Prime Minister's Office (PMO) said Tehri Hydro Development Corporation Limited (THDCL) had agreed to release 250 cumecs water from 21st December 2012 to 20th February 2013 and 220 cumecs water from 21st February 2013 to 28th February 2013 in view of demand of water for Allahabad `Kumbh Snans`.

Instructions have also been given by PMO that Delhi Jal Board should ensure that the performance of the 72 MGD sewage treatment plant (STP) at Keshavpur renovated and commissioned recently is stabilized so that it functions optimally and the effluent meets the norms.

The Delhi Government has been asked to ensure that the performance of the STPs and Common Effluent Treatment Plants (CETPs) is optimized to meet the effluent quality norms.

At Sangam, Allahabad, the BOD (Biochemical Oxygen Demand) of Yamuna and Ganga is generally less than 6 mg/ltr but the main issue is of the colour of effluents discharged by the pulp and paper industries into the river Ram Ganga and Kali (both tributaries of Ganga), the release said.

The Uttar Pradesh and Uttarakhand State Pollution Control Boards (SPCBs) have been directed to ensure that all the paper units discharging their effluents into river Ganga or its tributaries comply with the prescribed norms.

Monitoring of water quality in river Ram Ganga and river Kali and their tributaries is being initiated on a daily basis by the State Boards of Uttrakhand and Uttar Pradesh with the coordination of Central Pollution Control Board (CPCB), the release said.

Action will be taken against the industries for violating the norms. CPCB has issued show cause notices for closure to 23 tannery units in Unnao and Banther and, based on the response received and action taken, further course of action will be decided, the release added.

CCEA approves allocation of 16,200 tonnes of foodgrains for Kumbh Mela

The Cabinet Committee on Economic Affairs (CCEA) today approved the allocation of 16,200 tonnes of wheat and 9,600 tonnes of rice for the Kumbh Mela 2012-13 at Below Poverty Line (BPL) prices. 

An official press release said this would ensure availability of foodgrains to the tourists, devotees, kalpavasis, sadhus, religious and non government organisations (NGOs), security forces and officials involved with the organisation of the mela at subsidized rates. 
 
The allocation of the foodgrains at BPL prices will involve a subsidy of Rs 40.60 crore, the release said.
 
The Government of Uttar Pradesh had requested for allocation of these quantities of wheat and rice at BPL prices, it said.
 
Kumbh Mela 2012-13 which is an internationally renowned religious festival, is being held in Allahabad after a gap of 12 years and approximately seven lakh kalpavasis and sadhus are expected to participate. Many international tourists are also likely to attend it, the release added.

Ajit Singh writes to UP CM on land for airport at Allahabad

Union Minister of Civil Aviation Ajit Singh has requested Uttar Pradesh Chief Minister Akhilesh Yadav to transfer 50 acres of identified land in Allahabad to the Airports Authority of India (AAI) to develop a new Civil Enclave to handle civil airport operations in the city.

In a letter to Mr Yadav, Mr Singh said that, given the lack of space, AAI is not able to upgrade the Civil Enclave of Bamrauli Airport at Allahabad as the airport belongs to Indian Air Force. 
 
He said the AAI had already made a preliminary study of the surroundings of the airport area and discussed the matter with the Indian Air Force. 
 
The site measuring approximately 50 acres has been identified south of the airfield for development of new Civil Enclave. The new Civil Enclave will include new terminal building, apron to park civil schedule flights, link taxi track, car park, and so on.
 
Pointing out that Allahabad is one of the major cities of Uttar Pradesh and also has significant potential to enhance religious tourism, Mr Singh stated in the letter that the development of Bamrauli Airport will go a long way in development of eastern region of the State and also adjoining areas of Madhya Pradesh. 
 
The letter said that in case of any difficulty in acquisition and transfer of identified land, an alternative location having an area of 50 acres may be acquired and handed over to AAI at the earliest, as a number of representations have been received for development of the airport.

Rahul kickstarts Congress poll campaign in UP with Mayawati bashing

Giving a clarion call to the people of Uttar Pradesh, Congress General Secretary Rahul Gandhi today launched the party's election campaign for the upcoming state assembly elections with the slogan of "Utho, Jaago,
Badlo (rise, awake and change)."
 
Addressing a well-attended rally at Phulpur on the 122nd birth
anniversary of the country's first Prime Minister Jawaharlal Nehru, who had represented Phulpur parliamentary constituency, he called upon the UP public in general and youths in particular to strive for change in the development-starved state.
 
The party has finalised the slogan Utho, Jaago, Badlo and also will give a punchline in all its campaign materials "Jawab Hum Denge"(We will reply) as announced at the rally. 
 
"There was a time when Uttar Pradesh showed the entire nation the path of development. But today the entire nation is moving ahead, but UP goes backwards. The state of UP is ruled by the mafia and criminals," said Mr Gandhi during his address at the rally which was attended by all the Union Ministers and MPs from Uttar Pradesh.
 
Choosing his native place as the place to launch his party's campaign, the Congress general secretary displayed his aggresive posture ahead of assembly polls in UP and gave a hint of what was in store during the Congress campaign in the state for "Mission UP-2o12".
 
Launching a scathing attack on Mayawati government in UP, the Congress MP from Amethi mentioned the issues of lawlessness, corruption, misrule and attacks on women and poor people under her regime. He sought to highlight the poor record of non-Congress governments on development, crime, opportunities for youth and farmers' issues.

He also came down heavily on the allegedly bad state of affairs under the Mayawati Government in the state and said this was the constituency
of Nehru who showed Uttar Pradesh the path of development.   
 
"I am in politics for the past seven years and I visited many places in U.P. Experience taught me that unless a leader goes to the people, he cannot understand the problems of the common man," he said.
 
"Unless you drink the water from a poor man's home and get sick, you will not realise the real hardship of a common man. Unless a leader goes to a poor man's house, he cannot be angry after seeing the pathetic living conditions," he said.
 
He said there was a time when both Mayawati and former Chief Minister and Samajwadi Party leader Mulayam Singh Yadav used to be angry thinking of people's problems, but today they have forgotten the common people and are now bothered about only power.
 
The Congress leader also shared his experiences during his visit to Bundelkhand and regreted that despite the UPA Government's huge 
financial assistance to the state under this scheme, nothing was done to improve lot of the people. "In Bundelkhand, no one even knows about this MGNREGA policy and crores of rupees sent by the Centre are being misused by the BSP Government," he alleged.
 
Mr Gandhi even went to the extent of alleging that the money meant for
poor went into the pockets of the BSP leaders and as a result the poor
man gets nothing.
 
"I feel angry to see the bad state of affairs in Uttar Pradesh," he remarked.

He also asked why the people from Uttar Pradesh migrated to other places like Mumbai, Haryana and Delhi for a job. "Why can’t those people remain here and contribute to the state's development," he asked, pointing to what he said were the wrong policies of the state government.
 
Mr Gandhi also talked about the Bhatta-Parsaul incidents where the poor villagers were assaulted by the police and the atrocities against the women. He said that the UP Government forcefully acquired the lands of the poor villagers and farmers without giving them adequate compensation and sold it to big real estate corporates. 
 
"It was the Central Government which understood the gravity of the situation and drafted a Land Acquisition bill in 52 days. But some opposition political parties are opposing this. However,the Centre is determined to bring that bill for the benefit of the poor
villagers," he said.
 
Mr Gandhi also emphasised that the UPA Government was committed to introducing the Food Security Bill to ensure food to all and a strong Lokpal Bill to curb corruption. "But after introducing the Food Security Bill, I am not sure whether the UP Government will provide food to all or it will go to only BSP leaders, ministers and criminals," he said, taking a dig at the BSP rule.
 
He lashed out at the Mayawati Government saying that it was neck-deep in corruption. "The ministers are in jail, corruption is everywhere. Even if you want to file a FIR in a police station, you will have to bribe the police. No development is happening in the state for the past 20 years," he said.
 
Mr Gandhi who reached here this afternoon had to face some resistance also. Some SP workers were arrested trying to burn him in effigy. He was also shown black flags while about 20 SP activists had been arrested during his visit to Sangam city. He left Allahabad by a chartered plane after addressing the rally in Jhansi area on  the outskirts of Allahabad.
 
Before departing, Rahul Gandhi also visited Anand Bhawan, his ancestral place in Allahabad.

Rahul Gandhi to launch elections campaign for congress on Nov 14

Congress General Secretary Rahul Gandhi will launch the party's election campaign for th Uttar Pradesh Asembly elections, due next year, from Phoolpur in Allahabad on November 14, the birth anniversary of India's first Prime Minister Jawahar Lal Nehru.

On the day, a big public rally would be held in Phoolpur, the political constituency of the late Prime Minister, where people from all over the state would assemble, Congress election campaign committee chairman and Union Coal Minister Sriprakash Jaiswal announced here today.

Talking to mediapersons in the presence of UP Congress president Rita Bahuguna Joshi and legislature party leader Pramod Tiwari, Mr Jaiswal said the main agenda for the coming elections would be development.

"All the prominent leaders of the party will go to Phoolpur on November 2 to select the venue for the public meeting and to fix responsibities of the leaders for making the programme a grand success," he said.

4 dead in explosion in unauthorised fire cracker unit in Allahabad

At least four people were killed and five others critically injured when a house collapsed after an explosion in an unauthorised fire-cracker factory in Mauaima area of the district today.

Police sources here said that the explosion occured when people were manufacturing illegal crackers in the house in Miyapur village for the coming Diwali festival.

Due to the impact of the explosion, the entire house collapsed and some adjoining houses caught fire.

Some workers, who were inside the house, were also trapped under the debris and fire brigade personnel were trying to rescue them.

The injured have been rushed to hospital with severe burn injuries.

Mauaima area of the district is famous for fire-cracker production and many of the houses manufacture illegal fireworks.

Man accused of 1992 murder of Indian family in Dubai sentenced to death

A CBI court in Ahmedabad has convicted Ravjibhai Manubhai Pawar of the murder of his Indian employer and four other members of his family in Dubai in 1992 and sentenced him to death.

A press release from the Central Bureau of Investigation (CBI) said that its investigations had shown that Pawar, while working as a domestic servant in Dubai, had kileld Mr Ramesh K Sagar and four others of Mr Sagar's family on January 4, 1992.

He was also accused of rape and of stealing household articles, including clothes, ornaments and cash.

Pawar feld from Dubai on January 5 and came to India. On the basis of an Interpol alert, he was nabbed on January 10 by the Gujarat police and a first information report (FIR)was registered.

Since the accused was an Indian national and the offence took place outside India, the case was entrusted to the CBI. The Dubai Police had also registered an FIR and collected evidence, which was used by the CBI during investigation and trial of the case, the release said.

The chargesheet was filed on January 23, 1992 in the court of Chief Judicial Magistrate, Chikhli. The trial court found him guilty and convicted him.

The case was registered by the CBI, Ahmedabad (now Gandhinagar) Branch on April 27, 1992 on the basis of the request and consent of the Government of Gujarat for futher investigation of the case filed at the Chikhli Police Station, the release added.

Allahabad HC posts Badalpur acquisition case for hearing on Aug 17

The Allahabad High court today posted all the cases related to land acquisitions, including the petitions of Badalpur village, the native place of Uttar Pradesh Chief Minister Mayawati, to a larger bench which will take up the matter on August 17.

The bench comprising Justices Amitabh Lala and Ashok Srivastava posted several petitions challenging the land acquisition by the UP government for hearing on August 17.

About 50 farmers of Badalpur in Greater Noida, led by one Kartar Singh, have filed petitions challenging the land acquisition by the state government through allegedly illegal manner.

The petitions alleged that hundred of acres of land have been forcefully acquired by the state government without proper process.

The other petitions were filed by the farmers of Patwari, Khara Chamanpur, Iteda, Sahadra, Suthiyan and Roza Yakubpur.

On July 26, the bench of Justices Amitabh Lala and Ashok Srivastava had fixed August 17 as the next date of hearing of over 200 petitions challenging the land acquisition in Noida and Greater Noida by a larger bench.

10 people feared drowned after boat capsizes in Ganga in UP


At least 10 people were feared drowned when a boat capized mid-stream in the Ganga in the Manda area near here during a storm last night.


Police sources here today said that 10 people were going to Dhantulsi village in Bhadohi from Manda when their boat was caught in the storm.


Two bodies, including of a girl, have been recovered so far, while eight people were still missing and efforts were on to find them, the sources added.

HC orders ED probe into Amar Singh's companies


In a setback for expelled Samajwadi Party leader Amar Singh, a division bench of the Allahabad High Court today ordered a probe by the Enforcement Directorate (ED) in an alleged money laundering case involving his companies against which an FIR had been registered at Kanpur in 2009.


The division bench consisting of Justices Imtiaz Murtaza and S S Tiwari in their verdict have also vacated the stay given on the arrest of Amar Singh in the case.


The court has asked the ED to take up the case within two weeks and asked it to submit a status report on the investigation within one month. It has listed the case for hearing in the first week of July.


The court has also asked the ED officials to be present in person while submitting the first status report.


The judges in their observation said, "We are of the view that it is a pre-eminently fit case for a thorough probe by special cell as the matter has national ramification. The companies which are alleged to be shell companies are registered in various states and therefore the ED being a central agency shall be the appropriate cell to carry out a thorough probe."


The court delivered its judgement on writ petitions filed by Amar Singh to quash the FIR lodged by one Shivakant Tripathi at Babupura police station in Kanpur on October 15,2009. The respondent Shivakant Tripathi had also filed a petition demanding an ED probe into the case.

7 devotees killed in road accident in Allahabad


Seven devotees, including five women, were killed and an equal number injured when a tanker collided head-on with a sports utility vehicle (SUV) in Gangapar area of this religious city in Uttar Pradesh today.


The deceased were residents of Andhra Pradesh and had booked the SUV from Varanasi to Allahabad, police stated.


The ill-fated vehicle met an accident with the tanker on Faizabad-Allahabad highway. Of the injured, two were stated critical at hospital, police sources added.

Guard killed in fire at bank branch in Allahabad


One person was burnt alive and furniture worth thousands of rupees was gutted in a fire that broke out in the Bahadurganj branch of State Bank of Patiala in City Kotwali area of Allahabad late last night.


The victim was identified as Ram Sewak, the guard at the bank, police said.


The locker and the ATM were safe in the fire while furniture and computers were destroyed in the fire, police said.


The extent of damage was being ascertained, the police added.

Woman sets afire 3 minor children; commits suicide in Allahabad


A woman allegedly committed suicide after setting afire her three minor children in Holagarh area here today, police said.


Gudiya (32) tied her daughter Shivangi (8) and sons Mahesh (5) and Chotu (2) to a cot and set them on fire, police said.


Later, she poured kerosene on herself and put an end to her life, police said.


The woman took the extreme step after having a spat with her husband. The bodies have been sent for post-mortem examination.

Shanti Bhushan sends defamation notice on Digvijay Singh


The ongoing war of words between senior advocate Shanti Bhushan and the Congress today escalated when the former sent a legal notice for defamation to the party general secretary Digvijay Singh, seeking an apology for alleging that he had evaded stamp duty on a property in Allahabad and so was not suitable to remain in the Lokpal Bill Drafting Committee.


The eight-page notice, which underlined the Congress leader's interviews to various news channels commenting on Mr Bhushan's integrity, called upon him to immediately publicly apologise for giving "false statements which are highly damaging to Mr Bhushan's reputation."


"You are called upon to immediately publicly apologise for the incorrect allegations made by you against my client (Shanti Bhushan) failing which we will be constrained to take proceedings against you both civil and criminal in appropriate courts of law at your risk and cost," the notice sent by Mr Bhushan's lawyer Kamini Jaiswal said.


It said Mr Singh'a statements amount to defamation, both civil and criminal, under Section 499 of the Indian Penal Code punishable under Section 500 of the Code with imprisonment which may extend to two years.


A copy of the notice was also sent to Congress president Sonia Gandhi.


The Congress general secretary on April 15 had questioned the inclusion of Mr Bhushan and his son Prashant Bhushan in the Joint Drafting Committee to prepare the draft Lokpal Bill, alleging that they had evaded stamp duty to the tune of Rs 1.33 crore payable on a property in Allahabad.


Detailing about the Allahabad house sale deed, the notice said the senior advocate had been staying in the said house with his family as tenants for the last about 70 years. In 1966, he had an agreement to purchase it for a total sum of Rs 1 lakh which was the market value at that point of time.


"However, on account of the fact that the 99 years lease granted by the Government in favour of the owner had expired and was pending renewal, the sale deed could not be executed. Finally when the lease deed was renewed and the property was converted into free-hold my client demanded execution of the sale deed which was refused by the owner," it said.


Mr Bhushan then instituted a suit for specific performance in the year 2000 in Civil Court at Allahabad which was pending after which a compromise was arrived at between him and the owner.


Under the agreement, the owner agreed to sell a major portion of the property to Mr Bhushan with the remaining portion of 4317.78 square yards be left with the owner to sell independently to other persons, the notice said and added that the pending suit was decreed in terms of the agreement and it is in this background that the property was purchased for Rs 1 lakh.


Referring to the stamp duty, it noted that stamp duty of Rs 6,67,200 was paid under the Indian Stamp Act having a UP amendment that provides that stamp duty payable is on the market value of the property.


Mr Bhushan also sent an application to the Stamp Duty Collector under Section 31 for his opinion as to how much stamp duty should be paid on the proposed sale deed and also enclosed the copy of the proposed sale deed which had not yet been executed. The application was received in the office of the Collector on September 29, 2010.


"The sale deed was then executed on November 29, 2010 by the owner and the vendees and was duly registered by the Office of the Sub Registrar by paying the stamp duty," the notice read.


The civil rights activist also mentioned about the notice received by him on February 5, 2011 stating that the question relating to the proper stamp duty payable was pending before the authority. The Office of the Assistant Commissioner of Stamps Allahabad fixed a date of April 22, 2011 for determining the stamp duty was fixed.


"It has not been stated in the notice either that the property was under-valued or that adequate stamp duty had not been paid. Further it had not been suggested as to what the correct stamp duty payable was," it added.


It reiterated that Mr Bhushan's conduct in the case of purchase of the house has been exemplary and strictly in accordance with law.


A copy of the sale deed, application sent to the Stamp Duty Collector and notice received by the authority were attached with the notice.

SC stays trial court proceedings against Talwars in Aarushi murder case

The Supreme Court, in a special sitting on Saturday, stayed the criminal proceedings in the trial court against Dr Rajesh Talwar and his wife Nupur Talwar in the Aarushi-Hemraj murder case.

A bench comprising B Sudarshan Reddy and Mr Justice S S Nijjar, however, directed the dentist couple to deposit their passports in the court and not to leave the country without its permission.

The Talwars, parents of Aarushi Talwar, had approached the apex court against summons from the court in Ghaziabad to face trial in the double murder case. The Allahabad High Court had yesterday dismissed their petition and directed them to face trial.

The CBI had filed a closure report in the trial court saying that though Dr Talwar was the main suspect in the case, there was not enough evidence to proceed against him.

The trial court on February 9, however, rejected the closure report and summoned both the parents of the 14-year-old Aarushi to stand trial. It issued arrest warrants against them after they failed to appear in the court on February 28 in response to summons.

The dentist couple are facing charges of murdering hteir 14-year-old daughter and their domestic help on the night intervening May 14-15, 2008.

The couple are facing charges of murder and destruction of evidence.

Aarushi Talwar was a class IX student of Delhi Public School in Noida, Uttar Pradesh on the outskits of Delhi.
